Acceptable Use Policy
This Acceptable Use Policy ("AUP") governs the use of all services, products, and features provided by
KeksGas Inc. ("KeksGas," "we," "us," or "our"). By using our platform, you agree to comply with this AUP
in its entirety. Violation of this policy may result in immediate suspension or termination of your
account.
1. Scope & Applicability
This AUP applies to all users of the KeksGas platform, including coaches, consultants, their team
members, and any individual or entity accessing the Service. This policy supplements our Terms of Service and Privacy
Policy.
As a B2B coaching platform, KeksGas is intended exclusively for professional coaches, consultants, and
service providers operating a legitimate business. All usage must align with this professional context.
2. Permitted Use
The KeksGas platform may be used for the following lawful business purposes:
- Creating and managing a professional coaching or consulting website.
- Scheduling and managing client appointments and sessions.
- Collecting payments for coaching packages, group sessions, and digital content.
- Sending transactional communications directly related to active client engagements (confirmations,
reminders, receipts, system alerts).
- Delivering digital coaching materials, worksheets, and resources to enrolled clients.
- Managing client intake forms, exit surveys, and session notes.
- Integrating with authorized third-party tools (Stripe, PayPal, Zoom, Google Calendar, etc.).
3. Prohibited Activities
The following activities are strictly prohibited on the KeksGas platform. Any violation may result in
immediate account suspension or permanent termination without prior notice or refund:
3.1 Email & Communication Abuse
- Sending unsolicited commercial emails (spam), promotional newsletters, or marketing campaigns of any
kind.
- Using purchased, rented, scraped, appended, or harvested email lists.
- Conducting cold email outreach to individuals who have not explicitly opted in through a direct,
verifiable relationship.
- Sending communications that misrepresent the sender identity, sender domain, or the nature of the
message.
- Generating artificial or inflated email sending volumes (burst abuse).
- Sending communications that contain deceptive subject lines or misleading content.
- Using the Service to circumvent email deliverability controls, blacklists, or spam filters.
3.2 Content Restrictions
- Hosting, distributing, or linking to content that is illegal, harmful, threatening, abusive,
harassing, defamatory, or otherwise objectionable.
- Distributing malware, viruses, ransomware, or any malicious code.
- Hosting content that infringes upon intellectual property rights, trademarks, or copyrights of third
parties.
- Promoting or facilitating fraudulent schemes, pyramid schemes, multi-level marketing (MLM), or
deceptive business practices.
- Publishing content that promotes illegal drugs, unlicensed pharmaceuticals, weapons, or controlled
substances.
- Hosting adult, obscene, or sexually explicit content.
- Publishing content that promotes discrimination, hatred, or violence against any individual or
group.
3.3 Platform Abuse
- Attempting to gain unauthorized access to KeksGas systems, databases, or other user accounts.
- Reverse engineering, decompiling, or disassembling any part of the KeksGas software or
infrastructure.
- Using automated tools (bots, scripts, crawlers) to access the Service without explicit written
permission.
- Reselling, sublicensing, or redistributing the Service without authorization.
- Intentionally overloading, disrupting, or degrading the performance of the platform.
- Exploiting vulnerabilities or security weaknesses for personal gain or malicious purposes.
- Creating multiple accounts to circumvent limits, bans, or policy enforcement actions.
3.4 Financial & Regulatory Violations
- Using the platform for money laundering, terrorist financing, or any financial crime.
- Processing transactions for goods or services unrelated to coaching, consulting, or professional
services.
- Violating any applicable international, federal, state, or local laws and regulations.
- Facilitating transactions with individuals, entities, or regions subject to economic sanctions
(OFAC, EU sanctions lists).
4. Contact Sourcing & Consent Requirements
Organic Contact Sourcing Only: All contacts within your KeksGas account must be
sourced organically through legitimate means. Every contact must have explicitly consented to
receive communications from your coaching business through a verifiable Double Opt-In process.
Acceptable contact sourcing methods include:
- Direct client sign-ups through your KeksGas coaching page.
- Contacts acquired through in-person networking at professional events and conferences.
- Referrals from existing clients who provide written introductions.
- Contacts from your own legitimate website with a clear, compliant opt-in mechanism.
Unacceptable contact sourcing methods include:
- Purchased or rented email lists from any source.
- Scraped or harvested email addresses from websites, social media, or directories.
- Contacts from co-registration or third-party lead generation services.
- Contacts collected through deceptive, misleading, or non-transparent methods.
5. Monitoring & Enforcement
KeksGas actively monitors platform usage to ensure compliance with this AUP. Our monitoring activities
include:
- Email Pattern Analysis: Automated systems monitor sending patterns, bounce rates,
spam complaint rates, and other deliverability metrics.
- Content Review: We may review hosted content to ensure compliance with our content
policies.
- Account Audits: Periodic reviews of account activity, contact sourcing, and
business legitimacy.
- User Reports: Investigation of complaints and reports submitted by recipients,
third parties, or anti-abuse organizations.
6. Consequences of Violation
Depending on the severity and frequency of violations, KeksGas may take one or more of the following
actions:
- Warning: A formal notification outlining the violation and required corrective
actions.
- Temporary Suspension: Temporary suspension of the account pending investigation and
resolution.
- Feature Restriction: Disabling specific features (e.g., email sending, payment
processing) while allowing continued access to other platform functions.
- Permanent Termination: Permanent closure of the account with forfeiture of any
remaining subscription period. No refund will be issued for accounts terminated due to AUP
violations.
- Legal Action: In cases of severe violations, we may pursue legal remedies,
including seeking damages and injunctive relief.
7. Reporting Violations
If you become aware of any activity that violates this AUP, please report it to us immediately. We take
all reports seriously and will investigate each one promptly.
We encourage responsible disclosure and will not retaliate against users who report violations in good
faith.
8. User Responsibilities
As a KeksGas platform user, you are responsible for:
- Maintaining the security and confidentiality of your account credentials.
- Ensuring that all activities conducted through your account comply with this AUP.
- Supervising any team members or assistants who have access to your account.
- Promptly notifying us of any unauthorized access or suspicious activity on your account.
- Keeping your business and contact information current and accurate.
- Ensuring that all content published through your account is accurate, lawful, and does not infringe
upon third-party rights.
9. Changes to This Policy
We reserve the right to modify this Acceptable Use Policy at any time. Changes will be communicated
through a notice on our website or via email. Continued use of the Service after any modifications
constitutes acceptance of the updated AUP. It is your responsibility to review this policy periodically.
10. Governing Law
This Acceptable Use Policy is governed by and construed in accordance with the laws of the State of
Texas, United States of America, without regard to its conflict of law principles. Any disputes arising
under this AUP shall be subject to the exclusive jurisdiction of the courts located in Travis County,
Texas.
